Summary of the Request

The Request alleges various economic and environmental harms related to the construction, operation and maintenance of the Project, in particular:

i) Economic harm linked to the expropriation process, which has limited the access to water sources on the property of the Requesters affecting their productive activities and quality of life. They also point out that the expropriation process did not correctly consider the value of land at market price.

ii) Environmental harm linked to the risk of collapse of areas in the property of the Requesters that may have been provoked or encouraged by the extraction of material from the slopes of the Reventazón River. Likewise, they point harm caused by the generation of greenhouse gases given that vegetation had not been removed prior to filling the Project reservoir.

iii) Harm to the biodiversity of the area linked to the risk of collapse of the Lancaster Lagoons as an alleged consequence of the extraction work carried out on the slopes near those wetlands.

Recent actions

On March 3, the MICI Director determined that the Request is not eligible because it does not meet one of the eligibility criteria set out in paragraph 22 (d) of the MICI Policy. In particular, Management has not been given the opportunity to address the concerns of the Requesters in first instance and, since the MICI is a last resort mechanism, it considers that this step is still missing and has transferred the Request to Management. After notifying the parties, the procedure was terminated.

Past actions

On December 13, 2016 MICI granted the Requesters a maximum of 10 business days to submit additional information required to process the Request.

On December 29, 2016 the Request was registered upon receipt of the additional information. This action was notified to the Requesters and to Management.
