Summary of the Request
The Request alleges that the Requesters fear being affected by the “Tietê Várzeas Program” (BR-L1216) due to its lack of transparency and they expect potential harm due to the resettlement as they have no accepted the housing proposal offered as it does not complied with the provisions set in the Resettlement Master Plan. In addition they comment that project may also generate environmental harm.
Recent actions
On January 27, 2017, MICI Director determined that the Request is not eligible because it does not meet one of the eligibility criteria established in paragraph 22 (a) of the MICI Policy. During the process of mediation the Executing Agency agreements were reached with two of the three Requesters, so presuming compliance with them would result in the disappearance of the harm allegations.
However, for one of the three Requesters an agreement was not reached during the mediation process, which would continue alleged harm for this particular case and will merit a MICI process. However, the Mechanism Policy does not allow cases to be dealt in isolation, since the alleged harm would only persist for one of the three Requesters.
Past actions
On August 4th, 2016, the MICI granted the Requesters a 10 business day period to send the information required to continue with the processing of the Request (paragraph 20 of the MICI Policy).
On August 22, 2016, the Request was registered as the required information was submitted.
On September 20, 2016, Management sent its Response to the Request. The Response included apetition for a temporary suspension of the eligibility process for 45 working days (paragraphs 21 and 23.c of theMICI Policy), in order to establish direct contact with the Requesters having the intention to address the concerns expressed in the Request.
The MICI Director granted the suspension of the eligibility process for a period of 45 working days, which expired on November 23, 2016.
During the temporary suspension requested by Management, a mediation process was conducted with the Requesters to address the concerns of the Request. On December 5, the MICI Director requested the Board of Directors a 20 working days extension to the deadline to determine the eligibility of the Request, in order to allow such process to continue and for the formalization of agreements.
The Board of Executive Directors approved by Short Procedure that the new deadline for issuing the Eligibility Determination Memorandum would be January 27, 2017. This decision was notified to the Requesters and to Management on December 14, 2016.
